Kentucky ruling might speed Berry execution

MISSISSIPPI - The U.S. Supreme Court upheld Kentucky's use of lethal injection executions Wednesday, which could mean the pending execution in Mississippi of Early Wesley Berry would be on again. Berry was sentenced to die for killing Mary Bounds in 1987 in Chickasaw County. On Oct. 30, 2007, just 19 minutes before his sentence was to be carried out, the U.S. Supreme Court stayed Berry's execution pending a decision in the Kentucky case.

The justices, by a 7-2 vote Wednesday, turned back a constitutional challenge to the procedures in place in Kentucky, which uses three drugs to sedate, paralyze and kill inmates. Similar methods are used by roughly three dozen states, including Mississippi. Mississippi Attorney General Jim Hood later issued a statement saying Berry's petition to have his execution stopped could be denied by the U.S. Supreme Court as early as Monday. Read more.
