State judge stops execution scheduled in two weeks |

A North Carolina judge has stopped the April 16 execution for a man convicted of killing a 63-year-old clerk at an Asheboro convenience store. Lawyers for Kenneth Bernard Rouse argued their client was mentally retarded and shouldn't be put to death under state law banning the death sentence for inmates who are mentally retarded. A hearing will have to be held later to formally determine Rouse's mental state. Defense lawyers also had asked a federal judge to stop the execution while a challenge to lethal injection is heard in the U.S. Supreme Court. Rouse was scheduled for execution April 16. |
