| Overtime suit moves forward |

PENNSYLVANIA - U.S. District Judge Thomas I. Vanaskie denied a request by attorneys representing Lackawanna County asking that the lawsuit filed by 10 Lackawanna County Prison corrections officers be dismissed because they did not address their grievances through their union’s collective-bargaining agreement. The judge ruled Friday that the union’s collective-bargaining agreement doesn’t preclude employees from filing a Fair Labor Standards Act lawsuit. The corrections officers filed suit in May 2007, claiming the county is not paying them overtime for attending mandatory daily preshift meetings. They also claim they are due overtime for gathering their supplies — like batteries for their two-way radios — before starting their shift. Read more.
