| Deputy sheriff accused of assaulting prisoner |

A Rhode Island deputy sheriff has been charged with a federal civil rights violation for an alleged assault on a prisoner. In an indictment returned in U.S. District Court yesterday, a grand jury charged Charles Scherza, 33, of 11 Haddon Hill Road, Cranston, with violating the civil rights of inmate Jose Rivera-Rosa by punching and kicking him. The indictment said Rivera-Rosa, also known as Jose Lacen, was injured in the assault, allegedly occured on Sept. 26, 2001, in Providence's Garrahy Judicial Complex. He faces a maximum penalty of 10 years in federal prison and a $250,000 fine. The FBI investigated the case. A summons will be issued for Scherza to appear in U.S. District Court for arraignment. Last year, a state judge dismissed an assault charge against Scherza for the same incident. At the time, prosecutors said he had fractured Rose-Rivera's jaw and crushed two of his fingers after finding inmates smoking marijuana in a courthouse jail cell. He had been indicted on two felony assault charges in connection with the incident and had waived a jury trial. |
