| Judge rejects relevance of crowded jails |

AUSTRALIA - A judge has slapped down criticism of prison overcrowding by South Australia's second most senior magistrate, in a potential blow to his bid to sue the state's first law officer for defamation. The row over deputy chief magistrate Andrew Cannon's insistence that prison conditions were relevant to sentencing escalated last week after he issued defamation proceedings against Attorney-General Michael Atkinson for deriding his position as daft and delusional. Separately on Monday, Supreme Court judge Michael David upheld a police appeal against a decision by Dr Cannon to suspend the imprisonment of a house-breaker because of jail overcrowding, the starting point of the dispute with Mr Atkinson.
