DeKalb County may not have to pay a legal bill from inmates suing over medical conditions in the county jail. The Georgia Court of Appeals has ruled DeKalb Superior Court Judge Hilton Fuller did not spell out sufficient reason for ordering the county to pay inmates' lawyers $47,454, plus interest. The 5-2 decision, dated Friday and received by county officials Tuesday, sends the matter back to Fuller for reconsideration. Fuller ruled Feb. 24 that the county had tried to stall compliance with its agreement to improve medical care at the jail and therefore should have to pay the opposing lawyers' costs. The question of cost was a small part of a long-running legal battle over inmate medical care. The Court of Appeals earlier upheld Fuller's authority to hold the county in contempt and to oversee compliance with the medical agreement. The county has asked the Georgia Supreme Court to review that decision. |
