SOUTH AFRICA - In a ground-breaking judgment for the rights of children, the Pretoria High Court has declared certain aspects of the minimum sentences legislation to be unconstitutional. The law currently provides that young offenders who are 16 or 17 years old, must be sentenced according to the Minimum Sentences Act when they are convicted of very serious crimes. These sentences include life imprisonment or very long jail terms. These sentences are a required starting point and the courts may only depart from them if the offender shows that there are substantial and compelling reasons for the court to do so. Read more.
