KENTUCKY - Robert F. Dawson of Fayette County was sentenced to 20 years in prison in 2004 after being found in possession of a single gram of cocaine. Cia Michelle Carter of Jefferson County was sentenced earlier this year to 12 years for possessing five forged checks. Both had their sentences more than doubled because of their prior convictions -- under Kentucky's persistent felon law, extra years can be added to the sentence of an offender convicted of a previous felony, no matter how minor. According to a new study by the author of Kentucky's penal code, the state's 34-year-old repeat offender law is one of the most "draconian" in the country because, unlike in most other states, it is not limited to violent or serious crimes.
