Corrections loses license plate legal battle

SOUTH CAROLINA - When the General Assembly passed a bill in June allowing the S.C. Department of Motor Vehicles to create a license plate with an emblem of a cross on it and the words “I Believe,” it was pretty clear it wouldn’t be long before the state wound up in a court battle centered on separation of church and state. Sure enough, shortly after Gov. Mark Sanford allowed the bill to become law — without his signature — Washington, D.C.-based Americans United for Separation of Church and State sued the state in U.S. District Court. Americans United (AU) claimed the state-sanctioned plate unconstitutionally endorsed one religion over another.

On Dec. 11, a federal judge issued a temporary order blocking the DMV from distributing, producing and marketing the “I Believe” plates. The judge ruled after lawyers for AU, the DMV and the state Department of Corrections, which would be responsible for manufacturing the plates, argued for about an hour at the federal courthouse in Columbia.
