Key vote done privately

PENNSYLVANIA - The Erie Zoning Hearing Board took an unusual route when it approved a state prison pre-release center near Gannon University in November 2003. With the project up against a deadline, the board affirmed the zoning in an informal vote in private -- a move that city zoning records show ran contrary to state law.

The Zoning Hearing Board held a public hearing on the pre-release center on Nov. 11, 2003, but did not vote. The board approved the project on Nov. 14, 2008, by deciding in private, without convening a public meeting.

The Zoning Hearing Board cast its official vote at its next regularly scheduled meeting, on Dec. 9, 2003. On Nov. 18, 2003, four days after the informal vote and three weeks before the official vote, the chairman of the Zoning Hearing Board, Erie real estate broker Jeffrey J. Johnson, received $30,000.
