Juvenile advocacy group considers appeal

PENNSYLVANIA - Federal charges against two local judges left many members of Luzerne County’s legal community dismayed and disgusted on Monday, but still hopeful the specter of corruption would not taint the public’s perception of court system overall.

“The other members of the judicial bench who are above reproach should not suffer because of the actions of two corrupt individuals,” former county District Attorney Robert Gillespie said. “This really shakes the foundation of justice and that’s a sad, sad thing.”

Local litigators interviewed said they believe Court of Common Pleas Judge Mark A. Ciavarella Jr. and Senior Judge Michael T. Conahan, who both signed plea agreements based on corruption charges, represent an aberration. Even so, the two jurists’ confessions are likely to erode public trust, many said, and could impact several cases.

Attorneys with the Philadelphia-based juvenile advocacy group, who filed suit against the county last spring, are considering appeal options for their case. The Juvenile Law Center claimed hundreds of juveniles’ due process rights were violated by Ciavarella. Many of the juveniles were not told of their right to be represented by attorneys and were given detention center sentences instead of probation. Read more.
