Wrongfully imprisoned man wins suit

MISSISSIPPI - A $250,000 federal jury verdict will go to a Coahoma County man wrongfully imprisoned for 15 months by the Mississippi Department of Corrections. A jury took only 47 minutes to decide for Will Terrance Porter earlier this month before U.S. District Magistrate Judge Jerry A. Davis. Porter’s original attorney, J. Rhea Tannehill of Oxford, said Wednesday he couldn’t believe it when he heard what had happened to Porter.

“He had to get himself out of prison,” said Tannehill, who’s on active military duty at Camp Shelby preparing to ship out of Afghanistan. “This was completely about principle.” Oxford attorney Ray Hill III stepped in for Tannehill and took the case to trial. He deferred comments to Tannehill.

Porter filed suit May 3, 2007, against the Mississippi Department of Corrections and its commissioner, Christopher B. Epps, individually and in his official capacity. He accused them of false imprisonment, unlawful seizure and violation of due process. Porter pleaded guilty to an auto burglary and was on house arrest in April 2005, when he was arrested on suspicion of a misdemeanor. These charges were dropped, but MDOC’s house arrest officer had him transferred to the state prison in Pearl. After a hearing officer decided he had violated his house arrest, Porter’s original five-year sentence was reinstated at Epps’ direction and he was sent to Parchman. Read more.
