CALIFORNIA - California must release thousands of inmates from its overcrowded jails in order to improve conditions which violate prisoners rights, a panel of judges said in a preliminary ruling Monday. The three-man federal panel said there was "overwhelming" evidence that overcrowding in California's prison system was depriving inmates of the medical and mental health care they were entitled to under the US constitution. "There is uncontroverted evidence that because of overcrowding, there are not enough clinical facilities or resources to accommodate inmates with medical or health needs at the level of care they require," the panel said. "The evidence is compelling that there is no relief other than a prisoner release order that will remedy the unconstitutional prison conditions." California's Attorney General Jerry Brown said in a statement that the panel's final decision would be appealed in the US Supreme Court, describing the tentative ruling as "not constitutionally justified."
