Lethal Injection Law By: Laurie Dutcher After a year without any way of carrying out a death sentence, lawmakers pass a bill to make lethal injection the means to an end. Thursday, Governor Dave Heineman signed it in to law. Now, it's up to the state's Department of Corrections to determine exactly how they'll carry out the sentence. "Now I'll sign LB 36 into law," said Governor Heineman. With this signature, Nebraska joins 22 other states that administer lethal injection to those sentenced to death. "There is broad support for the death penalty in our state. The legislature had a thoughtful and serious debate," the governor continued. This debate raged for a year. The legislature examined cases like Baze v. Rees which challenged the constitutionality of lethal injection. These inmates claimed it 'was unnecessary risk of pain and suffering'. The case was ultimately ruled against. Regardless, Nebraska officials plan to go one step further. Making sure this new method sticks. "Crafting this bill was very thorough. I believe it will withstand scrutiny by the courts. We took into account what other states have done, what has passed constitutional muster by the U.S. Supreme Court," explained Nebraska Attorney General Jon Bruning.
