The former warden of Lee Correctional Institution, Calvin Anthony, hopes his court battles are over now that a federal appeals court has upheld the $510,000 Anthony won for his improper firing. “I feel blessed. I am elated. I think it’s going to be over this time,” Anthony, of Sumter, said after Tuesday’s ruling by the 4th U.S. Circuit Court of Appeals. Anthony sued Charles Sheppard, the Corrections Department’s inspector general at the time of his firing, in June 2004, and Robert Ward, another department official. Anthony said Ward and Sheppard conspired to have him fired as part of an agenda to punish certain individuals. Anthony had been warden for six years. A federal court jury awarded him the money after an April 2007 trial, and the three-judge appeals court panel rejected the appeal by Ward and Sheppard. Both men were disappointed, Corrrections Department spokesman Josh Gelinas said. They argued that they should not be sued for carrying out their official duties. “We don’t think the homes, savings and financial security of state employees, law enforcement officials, or members of state boards and commissions, should be jeopardized because of decisions they make while fulfilling their job duties,” Gelinas said. Anthony’s attorney, J. Lewis Cromer of Columbia, said Ward and Sheppard “have very few options.” He doesn’t think they will appeal further. Anthony said the suit “was never about money. And this was not just about me, but it was about all employees of the Department of Corrections who may have been treated unfairly.” Cromer said he was pleased Anthony’s reputation had “now been vindicated.” Read More. |
