Court grants stay to Mexican death row inmate, Oklahoman says |

The Oklahoma Court of Criminal Appeals granted a stay of execution to Osbaldo Torres, a Mexican citizen scheduled to die on Tuesday for the first-degree murder of an Oklahoma City couple, the Daily Oklahoman reported. The court ordered an evidentiary hearing on whether his case was prejudiced by the state's failure to inform Torres after his detention that he had the right to contact the Mexican consulate in accordance with the Vienna Convention, the newspaper said. It will also examine whether his counsel was ineffective. The court's 3-2 decision was issued a day after almost 150 people demonstrated outside the state Capitol, asking Governor Brad Henry to grant Torres clemency. |
