| Prison Terms Upheld For Adelphia Founder, Son |

NEW YORK (Dow Jones)--A federal appeals court on Monday upheld the prison sentences of Adelphia Communications Corp. founder John Rigas and his son Timothy after they were convicted in 2004 in a massive accounting scandal at the telecommunications company. In an opinion Monday, the U.S. Second Circuit Court of Appeals denied a bid by the Rigases to have their sentences reduced. The men had argued that U.S. District Judge Leonard B. Sand in Manhattan erred when he resentenced them last year by not reevaluating the alleged loss from their crimes. "We conclude that the new sentences imposed on the Rigases were procedurally and substantively reasonable," U.S. Circuit Judge Jose A. Cabranes wrote in the 25-page decision. The men were resentenced in June 2008 after the appellate court upheld 17 of 18 counts against them and dismissed a single count of bank fraud. The three-judge panel also affirmed the lower court judge's denial of a new trial for the men. A University of Kansas law professor who argued on behalf of the Rigases on appeal declined comment Monday. Read More. |
