| Ex-Medford captain wants prison term quashed |

ASHEVILLE — The reserve captain who helped former Buncombe County Sheriff Bobby Medford extort bribes from illegal gambling operators wants a judge to set aside his prison sentence. Guy Kenneth Penland, according to a court filing he wrote from prison in Kentucky, says his attorney refused to file an appeal without being paid more money. Penland, 78, said that violated his constitutional rights. He also said in his motion that he was denied a chance to read his federal pre-sentencing investigation report, which the judge used to determine his sentence. Federal law requires that defendants get a copy of the report. Penland, according to court testimony, collected protection money from video poker operators for Medford. He also worked to open new video poker locations as an employee of gambling operator Henderson Amusement Inc., helped gambling operators spy on a grand jury and detect an undercover federal officer who was watching them.
