2009 brought justice, heartache in court

The Clarksville-Montgomery County Court Complex filled daily and weekly to hear hundreds of criminal cases in the 19th Judicial District. The following are highlights of cases heard in Judge Mike R. Jones' and Judge John H. Gasaway's courtrooms at the Circuit Court level.

Andrew Cooper, 46, former boy's basketball coach at Northwest High School, entered a surprise guilty plea to first-degree murder of his ex-wife, Pamela Cooper, moments before his trial was to begin in April.

The plea carried an automatic life sentence. He was sentenced to 25 years for kidnapping. Gasaway told Cooper he would probably die in prison because he would not be eligible for parole for 51 years — until the age of 97.

Cooper shot his ex-wife 11 times and stabbed her in the chest after kidnapping her on July 23, 2007.

Timothy L. Diggs Sr., 36, went to trial in late July for the murder of 22-month old Christopher Andre Nicholson, who died March 21, 2007, from non-accidental blunt force injuries.

Following a bench trial, Diggs was found guilty by Jones of first-degree murder and aggravated child abuse. He was sentenced to life and will serve at least 51 years before he is eligible for parole.

A motion for a new trial was denied last week in Jones' courtroom. Steve Garrett, assistant district attorney, prosecuted the case. Assistant Public Defender Charles Bloodworth represented Diggs.

Robert Anthony Fusco, 28, was sentenced to 65 years in prison for attempting to rob Elke and John Gilreath in their Trahern Lane home and shooting Elke Gilreath in the hand and chest on Nov. 1, 2007.
