Man found guilty of assaulting officer Paul E. Sharp, 49, was found guilty Monday in Buchanan County Circuit Court of assaulting a correctional officer in 2007. Judge Dan Kellogg, who presided over the bench trial, sentenced the defendant to four years in prison for the class C felony, to be served at the same time as Mr. Sharp’s current, nine-year sentence. According to court testimony, a correctional officer asked Mr. Sharp to put out his cigarette at the Western Reception, Diagnostic and Correctional Center in St. Joseph on June 27, 2007. Mr. Sharp then grabbed the women’s hand and put out his cigarette in it. Under Missouri law, any intentional assault against a corrections officer constitutes felony assault. Class C felonies carry a range of punishment from a fine to seven years in prison. Public defender Trent Church argued that his client tried to put out the cigarette and didn’t know it still was lit when he put it in the woman’s hand. Mr. Sharp has 19 previous felonies on his record, and the St. Joseph man currently is serving a nine-year sentence on a possession of crack charge. A jury found him guilty of that back in September. Englert gets 5 years for selling meth David R. Englert, 39, pleaded guilty Monday to selling $250 worth of methamphetamine to an undercover Missouri State Highway Patrol officer last December. Mr. Englert admitted to meeting the man at the Speedy’s Convenience Store on St. Joseph Avenue. Judge Pat Robb followed the prosecution’s recommendation of five years. The range of punishment for a class B felony is five to 15 years. Mr. Englert’s sentence will run concurrent to a five-year sentence for possession of a controlled substance in Clinton County. The Chillicothe, Mo., man was out on probation when he sold the meth. Clinton County revoked his probation on that possession charge about two weeks ago.
