A treatment program for sex offenders resumed in prisons starting last Friday as the state appeals a federal court decision that found the program unconstitutional. In a one-sentence order dated last Tuesday, U.S. Circuit Court Judge Rosemary Pooler issued a temporary stay against enforcement of a decision in April that found the program violated inmates' Fifth Amendment rights against self incrimination. State prison spokesman James Flateau said the sex offender program would be restarted at the Gowanda correctional facility near Buffalo and at the Oneida correctional facility in Rome. It will be reinstated at other prisons this week, he said. About 650 inmates in all participate in sex offender treatment programs. |
