NH high court - is human waste assault?

CONCORD, N.H. — The New Hampshire Supreme Court is going to decide if a prison inmate who throws human waste on the floor and makes a correctional officer clean it up can be charged with assault.

A lower court said no, but the attorney general’s office wants the Supreme Court to overrule that decision.

The Concord Monitor says that currently it’s a crime for inmates to throw fecal material, urine or blood at prison staff.

The Supreme Court will rule on a case from the Hillsborough County jail in which six inmates were indicted last year on charges they threw urine and feces on a jail floor for staff to clean up.
