Accused bus driver had previous DUI

St. Johnsbury, Vermont - January 27, 2010

School bus driver Shane McBrayer, 30, pleaded not guilty in district court Wednesday to a charge of DUI.

McBrayer was arrested Saturday while driving the Mount Mansfield Union High School hockey team home from a game in Woodstock. Police say his blood alcohol content was .15-- more than seven times the legal limit for bus drivers. And it turns out McBrayer has an extensive criminal history.

School district officials Tuesday admitted they hired McBrayer despite knowing about two robbery-related convictions in the state of Georgia, but they say a DUI conviction was something they didn't know about.

"It isn't clear to me how I would have gotten that information," Chittenden East Superintendent Jim Massingham said. "It didn't come back on the criminal records check."

The school district performed three criminal records checks.

Officials with the Vermont Department of Public Safety say the DUI conviction wasn't listed on McBrayer's record because DUIs are only listed if it's a repeat offense or if the DUI resulted in death or serious injury.

Reporter Keagan Harsha: Knowing what you know now, would this have changed your decision to hire Mr. McBrayer?

Massingham: We normally don't hire people with convictions. This was unusual because of the recommendations we got. Knowing what I know now, I would have done it differently.

In addition to the background checks, district officials also contacted the department of corrections which was supervising McBrayer because of his previous robbery convictions. Again-- nothing about the DUI charges ever came up.
