Woman inmate gets more time for punching prison guard Note to self: If in jail, don't take a swing at any guards. A 20-year-old woman already serving a lengthy prison sentence on drug and weapons charges will spend more time in state prison for punching a Lebanon County correctional officer. Daniela Richard, formerly of Lebanon, was sentenced Wednesday to state prison for an additional two to 10 years and fined $750 for aggravated assault. After a trial before Judge Samuel A. Kline on Jan. 5, a jury found her guilty. She punched the female correctional officer twice in the face in the county prison on Feb. 10 last year. Richard was on several different types of medication when the incident occurred, said defense attorney Mark Schappell. He asked Kline to run her assault sentence concurrently with her sentences on the other offenses. Robert McAteer, senior deputy district attorney, said Richard should receive a consecutive sentence. "She's well on her way to (serving) life in prison on the installment plan," McAteer said. He said Richard showed no remorse for punching the prison guard. Kline said a consecutive sentence was appropriate because she had struck a prison guard. "This is a young lady with serious problems," the judge said. She has two prior drug convictions, Schappell said. On Dec. 31, 2008, Richard was sentenced to state prison for up to 19 years on charges of possession with intent to deliver nearly 35 grams of cocaine, receiving stolen property, possession of a firearm Advertisement Quantcast with an altered manufacturer's number, marijuana possession and conspiracy. Richard and her then-boyfriend Reginald M. Cabeche, 22, were convicted of the charges at a Dec. 5, 2008, trial. Cabeche received the same state prison sentence as Richard. Cabeche and Richard were arrested after police searched their apartment in the 600 block of Willow Street in Lebanon in the early morning hours of April 12, 2008. Police said they found large amounts of crack cocaine and marijuana; drug-packaging materials; $5,736 in cash; and two weapons with the serial numbers obliterated, one of which was reported stolen in Berks County. Police went to the home after several officers heard a gunshot while they were on routine patrol near the 600 block of Spring Street, an alley between Cumberland and Willow streets. Police rushed to the area and saw two men running north from Spring toward Willow. Their investigation led police to the apartment shared by Cabeche and Richard. After obtaining a search warrant, police found four other people in the apartment, including a juvenile. Richard was in the county prison awaiting sentencing on another drug charge when she struck the correctional officer. Richard was sentenced Feb. 25 last year to an additional two to five years for selling drugs while she was out on bail for her first drug offense. Her sentence from all three incidents totals 10 ½ to 34 years.
