Del. to pay $90,000 in discrimination suit

Delaware has agreed to pay $90,000 to settle a federal discrimination lawsuit by a Department of Correction employee who alleged that she was denied a promotion because she is a woman.
The settlement ends the U.S. District Court lawsuit brought by Millington, Md., resident Colleen Shotzberger against the Department of Correction, Commissioner Stan Taylor and Paul Howard, one of Taylor's advisers and chief of the state bureau of prisons.
Details of the settlement were made public recently through a Freedom of Information Act request to the state Attorney General's Office, which defended the lawsuit.
The agreement notes the parties wanted to resolve the case amicably without additional legal costs. The department and its officials admitted no wrongdoing.
Shotzberger will receive $34,025 of the settlement and the remaining $55,974 will go to her attorneys, Martin D. Haverly and Thomas S. Neuberger, according to the agreement.
It calls for attorneys not to comment to reporters beyond saying the matter was resolved amicably.
Shotzberger now works as a correctional treatment administrator, prison spokeswoman Beth Welch said.
Shotzberger sought a promotion in November 2001 to an administrative job overseeing the classification of all adult inmates. Classification involves planning for each individual's housing, medical and program needs, Welch said.
The promotion was given to a man who was one of four applicants. Shotzberger alleged she was better qualified and was the victim of discrimination because she is a woman.
The Equal Employment Opportunity Commission dismissed in October 2002 a discrimination charge she filed, after finding the evidence showed Shotzberger and the man who got the job were equally qualified.
Welch said two of Taylor's top three advisers are women.
None of the six current prison wardens is female, but women have held those jobs in the past. Three of five deputy wardens are women, she said.
