Judge Slows Guilty Plea

A career criminal already serving prison time wasn't allowed to plead guilty Wednesday in a new case because he hasn't yet talked with a lawyer. Brice Lewis Rogers, 38, was very clear that he was ready to admit guilt in Benton County Superior Court to second-degree identity theft, even though it was his first appearance in the case. Rogers figured that because he is behind bars, it won't hurt him now to add to the time he must serve. He told the court that if prosecutors wanted to give him about 31/2 years, "I'll take 'em." But Judge Robert Swisher felt otherwise, repeatedly asking Rogers if he really wanted to waive his right to be properly represented. Shawn Sant has been assigned to the case but wasn't available Wednesday. The case was handled by colleague Sal Mendoza Jr. "The offer from prosecutors will not go away in a week. It will still be there," Swisher said. "You want to wait at least a week and give him a chance to look at the police reports." Rogers responded: "Well, I'm already in custody, your honor."
