| Habitual Offending Offers 60 Years |

Herbert Russell, 56, faces up to 60 years in prison as a habitual offender and an additional 5 years on charges of sexually assaulting by fondling an 8-year-old victim, a Class 3A felony. Russell pleaded not guilty to both charges in Lincoln County District Court on Monday. Russell, a registered sex offender, has two prior convictions in the state of Kansas, both times serving sentences in the Kansas Department of Corrections and that is the reason he is being charged as a habitual offender in Lincoln County. Lincoln County District Court Judge Donald Rowlands scheduled Russell to face trial on June 29. Russell's bond is currently 10 percent of $500,000. His defense attorney argued for a bond reduction, but to no avail. "These are very serious charges against you and considering you are facing 60 years on the habitual criminal charge alone, I'm going to deny any reduction of bond," said Rowlands. Read More. |
