Trial In Assisted Suicide Case

The Dodge County District Attorney’s Office is preparing to wade into uncharted waters in the assisted suicide case of a Waupun inmate.

The case in which Joshua E. Walters, 21, allegedly helped his cellmate to commit suicide took another step forward during a motions hearing Friday in Dodge County Circuit Court. This is the first assisted suicide charge that has been filed in the state of Wisconsin, said Bob Barrington, office manager for the District Attorney’s Office. The case has been delayed twice while Walters’ defense attorney Randall Doyle sought mental health records of victim Adam Peterson to bolster his argument that the former Madison man was already suicidal and didn’t need his client’s help.

During the hearing, Judge Andrew Bissonnette granted a motion by Doyle to allow testimony of a psychiatrist who developed an independent profile of Walters regarding the inmate’s state of mind. Doyle said that Dr. Kent Berney’s testimony would also help to counter testimony of an inmate who came forward and told prison officials that Walters confided to him that “(Walters) and Peterson had the whole thing planned out”.
