SC Still Supporting HIV Segregation

The Palmetto State is one of only two in the country that segregates prisoners who have HIV or AIDS from the rest of the inmate population, according to a recent investigation and report published by the American Civil Liberties Union.

Alabama is the only other state in the nation to do so.

The ACLU and other organizations say the practice discriminates against prisoners with the disease and keeps them from participating in certain programs that could allow them early release. Also, it puts inmates who would normally serve their time in minimum-security settings into maximum-security prisons.

South Carolina has been separating HIV-positive inmates in its prison system since 1998, says S.C. Department of Corrections spokesman Josh Gelinas. He adds that its decision to do so has been upheld by the courts.

“It’s actually pretty simple,” he says. “Anyone who is convicted of a crime and to a state sentence more than 90 days, we test them when they come in. Before they leave, they’re assigned to specific dormitories for HIV-positive inmates.”
