Inmate sues Ala. jail authorities for $1 million |

Six months before complaints of abuse and neglect were made by four inmates at the Elmore County (Ala.) Jail, another detainee filed suit in December claiming a jailer kicked him while he was handcuffed in an unsanitary isolation cell. David Franklin Cotney is seeking one million dollars in damages. He accused Jail Administrator Gary Bowers of leaving him in a small cell, with only a grated hole in the floor as a toilet. Sheriff Bill Franklin denied the claim and described Cotney as an unruly inmate and said he was not abused. Cotney was held at the jail while facing federal charges involving methamphetamine possession and killing a police dog. A separate lawsuit, filed in May by four Elmore jail detainees, said they were shackled for days at a time without bathroom breaks. Their complaints prompted an investigation by the Atlanta-based Southern Center for Human Rights. The Sheriff said the allegations by the four inmates are false. Franklin also said that he and his staff will continue to run the jail as they always have. Cotney's lawyer, Jay Lewis, said his client is asking for a jury trial and will try to prove that Cotney's constitutional rights were violated. Both suits were filed in federal court. |
