A man was released from Department of Corrections on Tuesday after the district attorney did not file for a retrial in his 2006 assault case. Charles Greenwell was on parole in 2006 when he punched an elderly Florence man in the face, breaking a bone. He was convicted at trial of second-degree assault and sentenced to serve 16 years in DOC. The Court of Appeals ruled in November 2009 that it was improper for District Judge Julie Marshal to admit evidence of Greenwell’s drug use during the trial.
