| No Stay Of Execution For Gardner |

For the second time in a week, a federal judge has refused to issue a stay of execution for Ronnie Lee Gardner, who is scheduled to be put to death by a firing squad early Friday. Lawyers for Gardner wanted time to pursue a claim that a commutation hearing before the Board of Pardons and Parole had been "hopelessly biased" against their client. But at the conclusion of a hearing on Tuesday evening, U.S. district judge Tena Campbell said that argument was unlikely to prevail. "I simply cannot grant, on the evidence I have before me, the motion for the stay," the judge said.
