EDINBURG — A Brownsville man convicted of capital murder this week for the slaying and mutilation of three young children in 2003 is scarcely a model prisoner, correctional officers testified Tuesday. John Allen Rubio has proved to be an unruly inmate, one who set fires and tested positive for marijuana while in prison, the officials said Tuesday during the second day of testimony in the punishment phase of his trial. Rubio, 29 was convicted Monday of capital murder and is awaiting a decision on his sentence for the murders of Julissa Quesada, 3, John E. Rubio, 14 months, and Mary Jane Rubio, 2 months — the son and two daughters of his common-law wife, Angela Camacho. Rubio, the biological father of the youngest child, was convicted of the murders in 2003 and sentenced to death, but that conviction was overturned on appeal, effectively granting him a new trial.
