Although James Biela is now headed to death row after being convicted of the rape and murder of Brianna Denison and the sexual assault of two others, it may be years, even decades, before he actually faces his execution date because of Nevada's appeals process. It could take up to six years for his case to move through the first round of appeals in state court before it begins the cycle into and out of the federal system. And no one knows what changes might be made in the law that could affect his death sentence. Over the years, the length of time inmates spend on death row nationally and in Nevada has grown because of an increase in legal scrutiny of cases.
