| Guam Inmate Holding DOC Responsible For Teeth |

5:30 p.m. — An inmate serving a sentence of up to 15 years for vehicular homicide has filed a civil complaint in federal court against Department of Corrections officials and caseworkers and a prison doctor. James Weatherby alleged in the lawsuit that his request for DOC to provide him with dentures has not been granted. He said he needed dentures after five of his teeth were pulled out. Because of his lack of teeth, including molars, Weatherby states in the lawsuit, he’s been eating spicy Kimchee Bowl instant noodles twice a day, seven days a week, and that has led to abdominal pains. His lawsuit, filed in the U.S. District Court of Guam on Wednesday, said DOC’s failure to provide him with medical treatment violates his constitutional right to substantive due process. His lawsuit attached a DOC note that indicates his request for dentures was referred to a dental clinic in 2006. And in June 2009, another DOC inter-department note states the treatment plan awaits approval from the DOC director, and the cost would be $6,000. Read More. |
