Judge dismisses officer's sex charge |

A Montgomery County Court judge has dismissed a sexual assault charge against a Montgomery County corrections officer accused of exchanging commissary items for sex. Gene White, a former inmate, told authorities that Eileen Mayfield, 45, of Norristown engaged in a sex act with him when he was a prisoner in 1999. But Judge Bernard Moore threw out the charge Monday and granted a motion from Mayfield's attorney to bar a jury from hearing White's testimony because the alleged sex act occurred before a state law banning sex between inmates and prisoners took effect on Feb. 19, 1999. Mayfield was accused in 2000 of having indecent contact with inmates at Montgomery County Prison in Eagleville. According to police, she had sexual contact with the men in exchange for treats from the commissary. She was charged with institutional sexual assault. Mayfield lost a bid to have allegations by two other inmates, Jasper DiSantos and Jason Mascione, dismissed. Both alleged Mayfield indecently touched them while they worked in the prison commissary. No trial date has been set. Mayfield is free on recognizance bail. The judge's ruling means that Mayfield faces one less third-degree felony charge, which carries a maximum penalty of 31/2 to 7 years in prison, Assistant District Attorney Thomas McGoldrick said. |
