Judge Suggests Inmates' Lawsuit Thrown Out

STILLWATER, Okla. (AP) - A federal magistrate judge has recommended that a lawsuit filed by Payne County inmates against county and state officials be dismissed.

The Stillwater NewsPress reports that U.S. Magistrate Judge Gary Purcell made the recommendation to District Judge Lee West, who is presiding over the case in federal court in Oklahoma City. Court records do not indicate a hearing has been set for the case.

Nine inmates claim in the suit they are being denied rights and services given to prison inmates. Payne County Sheriff R.B. Hauf, District Attorney Rob Hudson and state Department of Corrections Director Justin Jones are named as defendants. Purcell says the inmates do not have a constitutional right to a shortened sentence for good behavior or to be housed in a particular facility. They are being held in the county jail because of overcrowding in state prisons.
