BILLINGS - A 61-year-old Billings man has been sentenced to 13 months with the Department of Corrections, plus four years probation, for what prosecutors say was his 14th drunken-driving offense. The Billings Gazette reports that District Judge Russell Fagg sentenced Timothy Roberts on Tuesday for felony DUI. Prosecutors say Roberts has 13 prior DUI convictions dating back to 1982, but they couldn't ask for a longer sentence under the state's persistent felony offender law because his last conviction was more than five years ago. Roberts was arrested May 28 after a sheriff's deputy found him asleep in a van at a Billings park. The deputy says the man was in the reclined driver's seat with the keys in the ignition, and a large beer can was on the center console. Roberts' blood-alcohol level measured 0.20 percent.
