An Aspen man was sentenced on Monday to five years in the Department of Corrections for drugging and having sex with a local girl who was 14 years old at the time. Jacob Frutin, 23, cried as he apologized for the crime, which occurred in November 2007. The victim’s mother also fought back tears while reading her statement in front of judge David Lass, who presided over Pitkin County District Court Monday. As part of a plea deal, Frutin pleaded guilty in July to the transfer of marijuana to a person under 15 and attempted sexual assault of a victim incapable of consenting, both of which are felonies. Prosecutors dropped charges of sexual assault of a victim under the age of 15 and unlawful distribution of psilocybin mushrooms. He will get credit for serving 586 days in Pitkin County Jail and the rest of his sentence will be served in state prison. After his release, Frutin will be on parole for five years, during which time he will be placed in an intensive sexual offender supervised program. If he violates his parole, he will serve another five years in prison. Read More. |
