Commissioner Denise Lord acknowledges that state policies may not be as explicit as the law center would like, but "just because there isn't a law prescribing certain kinds of practices, or prohibiting certain kinds of practices doesn't mean that the bad practice is what's in place," she says. "You can have exceptional practice without a law requiring you to do that." The Maine Correctional Center, which at any given time has about 160 female inmates, sees no more than a couple of pregnant women each year, so officials say there isn't the demand for a prison nursery called for by the law center. But they say the state makes the grade on other critieria used by the report's authors, such as offering HIV testing and ensuring women get prenatal medical exams.
