Marin County will sue the state over San Quentin State Prison's death row expansion plan, saying Gov. Arnold Schwarzenegger broke the law when he vetoed an effort delaying the $356 million project. The Board of Supervisors agreed in a closed session Tuesday to file a lawsuit challenging the gubernatorial budget veto, County Counsel Patrick Faulkner said. Schwarzenegger used a line-item veto in 2009 when approving the budget to dump funding limitations sought by Assemblyman Jared Huffman; the legislation included language requiring studies, resolution of system overcrowding, and legal justification of plans to double-bunk inmates.
