Death Row Expansion Causes Lawsuit Against State

Marin County will sue the state over San Quentin State Prison's death row expansion plan, saying Gov. Arnold Schwarzenegger broke the law when he vetoed an effort delaying the $356 million project.

The Board of Supervisors agreed in a closed session Tuesday to file a lawsuit challenging the gubernatorial budget veto, County Counsel Patrick Faulkner said.

Schwarzenegger used a line-item veto in 2009 when approving the budget to dump funding limitations sought by Assemblyman Jared Huffman; the legislation included language requiring studies, resolution of system overcrowding, and legal justification of plans to double-bunk inmates.
