Serial Killer May Be Removed From County

Should the Lassen County Superior Court grant a writ of mandamus seeking to remove serial killer Loren Herzog from the county?

Traci Witry, former Lassen County senior deputy county counsel, and Peter Talia, attorney for the city of Susanville and acting city administrator, filed the writ of mandamus Tuesday, Sept. 28 alleging the California Department of Corrections and Rehabilitation and the California Department of Parole “abused their discretion” by paroling Herzog in Lassen County “with no prior input from petitioners and without sufficient investigation of the facts and services available.”

The California Attorney General’s office, representing the state entities, responded CDCR did not abuse its discretion or “breach its ministerial duties” when it placed Herzog in Lassen County. Finally, the attorney general’s office argues granting the writ would “interfere with CDCR’s discretion in determining parole placement,” and should be denied.
