| State Wants Prison Time For Fatal Driver |

Saying the law is “clear and unambiguous,” Nevada Attorney General Catherine Cortez Masto urged the Nevada Supreme Court to deny a request from a DUI offender’s lawyer to let her out of prison on a house arrest program. The Legislature required the minimum two-year prison terms “in response to a public outcry over the tragic deaths and injuries caused by drunk drivers,” Masto said in her response to a motion filed by Scott Freeman, Jessica Winkle’s lawyer. Drivers who drink and kill or injure someone must serve at least two years behind bars before being eligible for any sort of release, Masto said. Winkle was one of eight DUI offenders sent back to prison following a Reno Gazette-Journal investigation that found that at least 40 of the drunken drivers convicted of killing or injuring someone since 2000 were let out before serving a two-year mandatory minimum term.
