An Athens man who authorities deemed mentally competent to face capital murder charges 24 years ago, is off death row on a federal judge’s order that classified him as retarded. Decatur Attorney John Mays worked with a Kansas City law firm to file a petition in U.S. District Court claiming that Kenneth Glenn Thomas was mentally retarded when he murdered 82-year-old Flossie McLemore in 1984. Mays said the petition was based on 2002 federal case law in which the U.S. Supreme Court ruled that execution of a mentally retarded person violates the Eighth Amendment of the Constitution, which prohibits cruel and unusual punishment.
