| Suicide, Lawsuit Couldn't Keep Man Out Of Jail |

A teen who is suing the state for alleged deplorable conditions in prison is back behind bars after he allegedly assaulted another patient at the Montana State Hospital. Judge Jeffrey Sherlock sent Raistlen Katka, 18, to the state hospital in June after four suicide attempts and several days of testimony on the issue of his placement. A scheduling hearing is slated for Dec. 14. According to court documents, Katka was transferred back to the prison on Thursday after Montana State Hospital staff learned that he had been showing aggressive behaviors toward another patient. The American Civil Liberties Union of Montana sued the state and Montana Department of Corrections on behalf of Katka in December 2009, claiming the teen had been held in solitary confinement for almost a year and that his treatment violates his constitutional rights.
