| Prisons Being Sued Over Environmental Issue |

The U.S. Environmental Protection Agency has sued two state agencies over emission violations attributed to coal-fired boilers at four state prisons, including Rockview. Filed with the suit last Friday in U.S. Middle District Court against the Department of Corrections and Department of General Services was a proposed consent decree in which the commonwealth agrees to pay a $300,000 civil penalty and take corrective action. The decree, which is available for public comment, needs approval from Judge Christopher C. Conner. EPA attributes the emission problem at Rockview to three coal-fired boilers and says violations have occurred from at least April 25, 2006. The suit states violation notices for Rockview were issued on Aug. 15, 2006, and Oct. 22, 2007. The prison is accused of repeatedly exceeding visible state emission limits. Penalties the state faced at Rockview were up to $32,500 a day for each violation after March 15, 2004, and up to $37,500 a day for those occurring after Jan. 12, 2009, the court complaint states.
