Vermonters accused of killing someone while driving drunk generally face a charge of driving under the influence with death resulting. As the state’s attorney researches relevant laws in the case, a legal expert explained Monday the ways prosecutors might go about levying a murder charge, with a more severe punishment, against a man charged in a fatal car crash in downtown Burlington two weeks ago. Prosecutors say Timothy Dowd, 52, led Burlington police on a three-minute high-speed chase Dec. 26 before slamming the Jeep Cherokee he was driving into a car driven by Kaye Borneman at the intersection of Main and St. Paul streets. Borneman, 43, of Burlington was killed instantly, according to court papers. Dowd pleaded not guilty the next day in Vermont Superior Court in Burlington to the initial charges of gross negligent operation with death resulting and attempting to elude law-enforcement officers.
