| Prisoner Hormone Treatments Unethical |

An attorney for the state argued Monday that a federal judge erred when he ruled last year that a law banning transgender Wisconsin inmates from getting hormone therapy was unconstitutional. But a three-judge panel of the U.S. 7th Circuit Court of Appeals did not appear too receptive to the state's position, peppering the state's lawyer with tough questions and skeptical observations. In April, U.S. District Judge Charles Clevert found the state's 2005 "Sex Change Prevention Act" unconstitutional. He found that the law amounts to "deliberate indifference to the plaintiffs' serious medical needs in violation of the Eighth Amendment" because it denies hormone therapy without regard to those needs or doctors' judgments. Assistant Attorney General Abigail Potts said she thought Clevert made four key errors in reaching his conclusion. She said he seemed to focus too much on what the law would deny rather than other alternatives still available to inmates, such as treatment with anti-depressants and psychotherapy. The panel - including appellate Judges Diane Wood and Ilana Rovner and a U.S. District Judge Joan Gottschall - asked if the Legislature could then pass a law to ban any pregnant inmate from having a Caesarean section.
