Guard Faces Civil Rights Case For Beating

Allegheny County Jail guard Arii L. Metz, already charged in state court with the October beating of inmate David Kipp, was indicted today in U.S. District Court for deprivation of civil rights.

The indictment was the first obtained by U.S. Attorney David J. Hickton's new civil rights unit. Details of the indictment were not immediately available, but Mr. Metz's attorney, James A. Wymard, said it was for the incident involving Mr. Kipp.

Mr. Metz was released on $25,000 unsecured bond. Assistant U.S. Attorney Amy Johnston said he faced a maximum penalty of 10 years in prison and a $250,000 fine if convicted of the charge.

State charges of aggravated assault against Mr. Metz, and charges of falsification of reports, obstruction of administration of law, and official oppression against him and fellow guard Marcia L. Williams, are proceeding. Mr. Wymard said there is much overlap between the federal and state charges, and promised an aggressive defense.
