A Pearl River County man has been found guilty of fondling a then five year-old girl in 2007. Levi L. Jenkins, who is now 22 years-old, was found guilty of fondling the victim between the dates of July 1, of 2007 and Aug. 5, 2007, said District Attorney Hal Kittrell. The trial was held on Wednesday and Thursday in the Pearl River County Circuit Court with the honorable Judge Tony Mozingo presiding. Kittrell said the case initially included three charges against Jenkins, two sexual battery charges and one statutory rape charge. However, when the case went to trial, Kittrell said the victim’s testimony changed from what she told the prosecution during the numerous previous interviews, forcing the court to change two of the charges during the court proceedings. Kittrell said the victim’s testimony changed during the prosecution’s questioning. Kittrell said the court, based on the change in the victim’s testimony, granted the changes which included changing one of the sexual battery charges to attempted sexual battery and the statutory rape charge to attempted statutory rape. Also as a result of the changed testimony, the jury instructions included consideration on the last charge of sexual battery to be a lesser conviction of fondling, Kittrell said. Kittrell said after the jury deliberated on Thursday, the members found Jenkins not guilty of the attempted sexual battery and not guilty of the attempted statutory rape, but did find him guilty of the lesser charge of fondling associated with the remaining sexual battery charge. A conviction of fondling carries with it a maximum sentence of 15 years, to which Mozingo did sentence Jenkins on Thursday after the jury made its decision, Kittrell said.
